Privacy Policy

The purpose of this Privacy Policy is to set out the terms and conditions regarding the use of the information and data shared with Kobaküs Ödeme Hizmetleri A.Ş (the “Company”) by persons who register as members of the website located at www.kobakus.com (the “Site”) (the “User(s)”) while benefiting from the Platform on the Site. The Privacy Policy is an annex to, and an integral part of, the User Agreement concluded with the User.

The Content uploaded to the Site by the User is the property of the User. The Company will not disclose or sell this Content without the User’s prior consent.

The Company will not disclose to third parties the Content transmitted to it electronically through the Site beyond the purposes and scope determined by the User Agreement concluded with Users. In this context, the Company undertakes to keep the Content strictly private and confidential, to regard this as a duty of secrecy, and to take all necessary measures and exercise due care to ensure and maintain confidentiality and to prevent all or any part of the confidential information from entering the public domain, being used without authorization, or being disclosed to a third party.

Where the User gives consent to the Company, Content may be processed, stored, and — for purposes such as payment transactions, invoicing and its processing, bank integration, third-party applications to which the User has granted access, and direct marketing — transferred by the Company and its partners to third parties in order to provide the services requested by the User, within the framework of the consent given by the User.

The Company may disclose the Content to other users in order to provide requested services such as sending invoices and sharing payment information. Where the User wishes to use Content belonging to another user, the Company will obtain consent from the relevant user and use the Content within the scope of such consent.

Personal information may be used to contact the User or to improve the User’s experience on the Site (such as maintenance and support for the services, improvement of existing services, creation of new services, and provision of personalized services), and may also be processed, stored, and transferred to third parties in order to build a database, maintain memberships, and carry out the other activities necessary to provide the Company’s services to the User.

The Company may anonymize the usage and transaction information performed by the User on the Site and store, process, and transmit it to business partners for use in statistical evaluations, performance evaluations, the marketing and donation campaigns of the Company and its business partners, and in annual and similar reports, for the period required to achieve these purposes.

Information requested from Users who respond to periodic or non-periodic surveys that may be conducted via the Site and who consent to the processing of their personal information may be used by the Company to carry out direct marketing to such persons, perform statistical analysis, and build a database.

The Company may also share information belonging to the User with third parties where the following conditions exist:

  • where the relevant disclosure is mandatory for the fulfillment of obligations under the User Agreement,
  • where information about users is requested by an authorized administrative or judicial authority for the purpose of an investigation or inquiry duly conducted in accordance with the relevant legislation,
  • where it is necessary to provide information in order to protect the rights or safety of users.

For the identification and resolution of technical problems related to the system, the Company may, where necessary, need to identify and use users’ IP addresses. IP addresses may also be used to identify users in a general manner and to collect comprehensive demographic information.

The Company has the right to transfer the relevant data, for the purposes mentioned above, to its servers located anywhere in the world outside the country in which the User resides (such servers may belong to the Company, its affiliates, or its subcontractors).

It is possible to provide links from the Site to other sites and applications, and the Company bears no responsibility for the privacy practices or contents of such sites and applications.

The Company may change the provisions of this Privacy Policy at any time by publishing them on the Site. The provisions of the Privacy Policy amended by the Company take effect on the date they are published on the Site.
